That Rajasthan Housing Board floated scheme for providing Flats in Indra Gandhi Nagar, Jagatpura, Jaipur in the name of Self Financing Scheme year 2012 (II) and invited applications on 14.12.2012 and last date of submission of application under the scheme was 21.01.2013 in the scheme 360 flats were floated in MIG-B Scheme. In the Scheme flat area was shown as 1451.16 sq. feet (Super built up) and estimated cost was shown for Rs. 29.60 Lacs. That myself under the bonafide belief that flat will be provided under the scheme within reasonable time and cost will be about 30 lacs only, I submitted application within time along with requisite payment of Rs. 2,96,000/-. After depositing the registration amount , Rajasthan Housing Board issued reservation letter vide letter no. 7713 dt. 09/12/2013 and given schedule for payment and accordingly I deposited the entire amount (with service tax at the prevailing rate) as per schedule provided in reservation letter dated 09/12/2013 a! nd deposited the amount after taking loan from the Union Bank of India.
That vide allotment letter No. 7044 dated 24.03.2017 under the signature of Estate Manager, Rajasthan Housing Board, JC-III, Jaipur allotment in relation to the Flat No. 8/MB/B-2/708 (7th Floor) and Parking No. B2/SP-70 in Indra Gandhi Nagar, Self-Finance Scheme, Jaipur was issued and raised additional demand of Rs. 7,68,300/-. In addition to it a demand was also raised for Rs. 1,44,900/- as maintenance charge and amount of Rs. 70,721/- was demanded for 1 time lease money. The demand which have been raised by the Rajasthan Housing Board is not only arbitrary but same has been raised unilaterally, malafidely and excessive demand which is liable to be reduced and set aside. That the construction cost which have been charged for the above mentioned flat is @ Rs. 2034/-per sq. feet while from other allotees in the same time have charged construction cost @ Rs. 1640/- per sq. feet which have been charged from other allottes in Saryu Apartment of Housing Board Scheme which is at!
better place as such the construction cost is required to be reduced to Rs. 1640 per sq. feet in place of Rs.2034/- per sq. feet.
That at the time of booking of flat total cost was shows as Rs. 29.60 lacs and now the cost have been increased which is more than 33% which is very excessive and same have been increased unilaterally as such same is required to reduced.
That the service tax which was applicable in the Allotment was 3.09% upto 30.05.2015, 3.50% from 01.06.2015 to 14.11.2015, 3.625% from 15.11.2015 to 31/05/2016 and now the service tax is @ 3.75 % only from 01.06.2016 till now. But, by way of demand letter dated 24.03.2017 service tax have been calculated @ 4.50% on the entire amount (which is to be levied on difference payable amount and that too @3.75%) which is not only illegal and arbitrary and same is liable to be reduced.
That I booked the flat in January, 2013 and the persons who have booked the flat in April, 2013 in similar Scheme of Saryu Apartment were given possession of the flat in May, 2016 while I have booked the flat prior to the same have not been given possession even till today which has caused delay and the Rajasthan Housing Board is liable to pay interest on delay, It may also be noted that I have deposited the entire amount after taking loan from Union Bank of India.
That as per the scheme and present Apartment Rules applicable in Rajasthan amount cannot be charged for reservation/ allotment of parking while the amount of Rs. 1,67,795/- plus service tax have been charged from me which is also not leviable.
That in view of the above noted facts the demand which have been raised vide allotment letter dated 24.03.2017 is liable to be reduced as aforementioned.
